    Terms of Use

    These Terms of Use ("Terms") apply to your use of the AskLara mobile app and related services ("AskLara," the "App," or the "Service"). AskLara is operated by Smooth Consulting UG (haftungsbeschraenkt), Mozartstr. 35, 70180 Stuttgart, Germany. Contact: support@asklara.app.

    By using AskLara, you agree to these Terms. If you do not agree, do not use the App.

    Eligibility

    You must be at least 18 years old to use AskLara. AskLara is for parents and other adults. Children must not use the App directly or submit personal information.

    What AskLara Provides

    AskLara is an AI-supported parenting app. It can provide general, informational guidance about pregnancy, postpartum life, babies, child development, parenting, family routines, and related topics.

    THIS IS NOT MEDICAL ADVICE.

    AskLara does not provide medical, psychological, legal, emergency, or professional advice. AI-generated answers may be incomplete, outdated, or wrong. You are responsible for deciding whether and how to use any information from the App.

    AskLara does not create a doctor-patient, therapist-client, attorney-client, or other professional relationship. Do not ignore or delay professional advice because of information provided by AskLara.

    For medical, psychological, safety, legal, or emergency concerns, contact a qualified professional or local emergency services.

    Accounts and Access

    AskLara may create an anonymous app account or use app-specific identifiers to save onboarding information, conversations, subscription status, and settings. You are responsible for keeping your device and account access secure.

    We may suspend or restrict access if we reasonably believe the App is being misused, a subscription is inactive, or continued access may create legal, security, or safety risk.

    Subscriptions, Trials, and Payments

    Paid features may be offered through auto-renewable subscriptions, trials, or other in-app purchases. Prices, trial terms, renewal periods, taxes, and available plans are shown in the App Store or purchase screen before purchase.

    Purchases are processed by Apple through the App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period, or as otherwise stated by Apple at purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the chosen package.

    You can manage subscriptions and turn off auto-renewal in your Apple account or App Store subscription settings after purchase. If a free trial is offered and you purchase a subscription before the trial ends, any unused portion of the free trial may be forfeited where permitted by Apple. Refund requests are handled by Apple and are subject to Apple's policies.

    If your subscription expires, is cancelled, or cannot be verified, access to paid features may end.

    Acceptable Use

    You agree not to:

    • use the App for illegal, harmful, abusive, or deceptive purposes;
    • submit content that infringes rights, contains malware, or is intended to disrupt the Service;
    • copy, resell, scrape, reverse engineer, or commercially exploit the App except where allowed by law;
    • use App content or outputs to train AI models or competing services without our written permission;
    • attempt to bypass paywalls, security, rate limits, or technical restrictions;
    • let a child use the App directly or submit personal information.

    User Content

    You keep any rights you have in questions, feedback, or other content you submit. You give us permission to process that content to provide, maintain, secure, and improve AskLara, including by sending relevant content to service providers such as AI, hosting, analytics, subscription, and notification providers as described in our Privacy Policy.

    Do not submit sensitive information that is not needed for the Service.

    Intellectual Property

    AskLara, including the App, software, design, branding, text, prompts, content structure, and other materials provided by us, is owned by or licensed to us and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. You may use AskLara only as permitted by these Terms and applicable law.

    AI Output

    AI output is generated automatically and may not be accurate, complete, safe for every situation, or suitable for your family. AskLara is designed to support everyday parenting reflection and orientation, not to replace professional judgment.

    You should independently verify important information and seek professional help where appropriate.

    App License and Apple Terms

    The App is licensed, not sold. Your use of the App through the Apple App Store is also subject to Apple's Standard End User License Agreement unless a custom license is provided by Apple or us for the App.

    Apple is not responsible for providing maintenance or support for AskLara, except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms for App Store distribution purposes and may enforce these Terms against you as a third-party beneficiary.

    Privacy

    Our Privacy Policy explains how we collect, use, and share information. By using AskLara, you acknowledge the Privacy Policy.

    Availability and Changes

    We try to keep AskLara available and useful, but we do not guarantee uninterrupted or error-free operation. The App may be unavailable because of maintenance, technical issues, third-party service outages, app-store issues, or other reasons.

    We may change, suspend, or discontinue features, content, prices for future purchases, or the Service. If changes materially affect your rights or obligations, we will take reasonable steps to notify you.

    Disclaimers

    To the fullest extent allowed by law, AskLara is provided "as is" and "as available." We disclaim warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

    Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

    Indemnification

    To the fullest extent allowed by law, you agree to indemnify and hold harmless Smooth Consulting UG from claims, losses, liabilities, damages, costs, and expenses arising from your violation of these Terms, unlawful use of the App, or infringement of another person's rights.

    Limitation of Liability

    To the fullest extent allowed by law, Smooth Consulting UG will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity.

    Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional misconduct, gross negligence, or injury to life, body, or health where applicable law does not allow limitation.

    Termination

    You may stop using AskLara at any time and may cancel subscriptions through Apple. We may suspend or terminate access if you violate these Terms or create risk for the Service, other users, or us.

    Governing Law

    These Terms are governed by the laws of Germany, without excluding mandatory consumer protection rights that may apply in your country or state of residence.

    Informal Dispute Resolution

    Before filing a claim, you agree to contact us at support@asklara.app and describe the dispute in reasonable detail. We will try to resolve the dispute informally within 60 days. This does not limit rights that cannot be waived under applicable law.

    California Users

    Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, USA, or by phone at 1-800-952-5210.

    Copyright Complaints

    If you believe content in AskLara infringes your copyright, contact support@asklara.app with enough information for us to identify the content and your rights. We may remove or restrict access to allegedly infringing content where appropriate. A formal DMCA designated-agent registration should be completed before relying on DMCA safe-harbor procedures.

    Export Control

    You may not use, export, or re-export AskLara except as allowed by applicable export control and sanctions laws.

    General Terms

    If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us for your use of AskLara. We are not responsible for delays or failures caused by events beyond our reasonable control.
